Obiettivi formativi
Il corso si propone di far acquisire agli studenti la conoscenza delle problematiche connesse al tema dei diritti degli animali. Si tratta di una materia molto complessa e frammentata, che affonda le sue origini nella cultura e nella filosofia e subisce influenze da numerosi gruppi di pressione, correnti di
pensiero, interessi economici o di altra natura. In alcuni casi, il diritto animale è conseguente a motivazioni che interessano il benessere, il guadagno o la salute degli esseri umani: le leggi in materia sanitaria e veterinaria ne sono un esempio. Il tema dei diritti degli animali sarà esaminato in questo corso in una prospettiva di diritto comparato, avendo cioè riguardo alle esperienze in questo campo che sono proprie di alcuni sistemi giuridici.Comparative Animal Law is a study of the range of ways that law affects and protects animals in the legal systems. This course will introduce students to the broad range of laws, including statutes, case-law, interdisciplinary studies on Animal Law & Policy, that affect non-human animals (“animals”), including companion animals and corporate use of animals: farm animals (with a particular focus on factory farms), animals used in the context of entertainment (such as zoos and aquaria), animals used in scientific experimentation, and wild animals. Until fairly recently, most laws reflected the belief that animals had only instrumental value. Society recognized that animals had market value, but not that animals’ sentience, physiology, and social cultures entitled them to ethical consideration. Changing concepts concerning the place of animals in the world have slowly affected courts, legislatures, and law enforcement authorities in every culture and society.
Topics to be discussed during the semester include how animals have been defined by courts and legislatures, interpretation and enforcement of state animal welfare statutes, and liabilities issues connected with the guardianship/ownership of animals. We will also consider the ethical implications of using animals for experimentation.
The course will provide students with a comparative survey of domestic laws arising from other countries than Western Legal tradition ones, and will take into account formal international agreements as well as international governing bodies such as World Trade Organization. We move from continent to continent to provide some examples of how different countries and regions are approaching animals and the law. The course will focus mainly on the Anglo-American legal system (USA and Canada) but will also include significant attention to the laws of Asia and Africa. Students will have the opportunity to discuss the broader philosophical debates surrounding animal welfare issues, including consideration of the appropriate legal status of animals.

The course aims at enhancing knowledge and understanding, learning and communication skills, as well as the capacity of making judgements, with particular reference to the topics addressed. In addition to reading the materials and participating in class discussions, students will be required to write a substantial paper on an issue related to animal law.
